An administrative law judge (ALJ) for the Division of Unemployment Insurance of the Department of Workforce Development issued a decision in this matter. A timely petition for review was filed.

The commission has considered the petition and the positions of the parties, and it has reviewed the evidence submitted to the ALJ. Based on its review, the commission agrees with the decision of the ALJ, and it adopts the findings and conclusion in that decision as its own.

DECISION

The decision of the administrative law judge is affirmed. Accordingly, the request for hearing is dismissed. The initial determination remains in effect.

MEMORANDUM OPINION

The employee has petitioned for commission review of the adverse appeal tribunal decision. It is the employee's position that he did not understand the specific questions that he was asked. The employee thought the ALJ was asking about a different packet that he received prior to his hearing. The employee did not read the "final packet" because he knew what time his hearing was going to be. The ALJ asked the employee about the hearing notice, which was sent to him and which informed him of the date and time of the hearing. In the middle of the page, the hearing notice states "IMPORTANT MESSAGES" and explains that his phone must accept calls from "blocked" phone numbers. The hearing notice is not unduly burdensome to read and contains important information about attending a hearing. It was the employee's responsibility to familiarize himself with the hearing notice. His failure to do so does not amount to good cause for missing his hearing.
