An administrative law judge (ALJ) for the Division of Unemployment Insurance of the Department of Workforce Development issued a decision in this matter. A timely petition for review was filed.
The commission has considered the petition and the positions of the parties, and it has reviewed the evidence submitted to the ALJ. Based on its review, the commission agrees with the decision of the ALJ, and it adopts the findings and conclusion in that decision as its own.
The decision of the administrative law judge is affirmed. Accordingly, as of week 9 of 2011, the claimant is ineligible for extended training benefits.

The claimant has petitioned for commission review of the adverse appeal tribunal decision which found that the claimant was not eligible for extended training benefits. As noted by the ALJ the FSET Program is no longer administrated by the Department of Workforce Development. The claimant's course of training is not given by a technical college or training institution approved by the department, and is not administered by the Department of Workforce Development. The claimant's training does not meet the definition of "approved training" under Wis. Stat. § 108.04(16). Therefore, the claimant is not eligible for extended training benefits.
