O R D E R

Wisconsin Statute § 108.09(6)(d) provides that the commission may affirm, reverse, modify, or set aside the appeal tribunal decision on the basis of the evidence previously submitted, may order the taking of additional evidence, or it may remand the matter to the department for further proceedings. Pursuant to authority granted in Wis. Stat. § 108.09(6)(d), the commission sets aside the appeal tribunal decision in the above-referenced matter, and remands the matter to the hearing office for another hearing and decision.

NOTE: The commission remands this matter because the voices of the witnesses were faint and faded out on numerous occasions. The quality of the recording is such that the commission is unable to produce a complete and accurate synopsis that fairly reflects the relevant and material testimony presented at the hearing. The commission suggests that measures be taken to assure that witnesses and those individuals questioning the witnesses are sufficiently close to the recording device for the questions and the testimony to be recorded in a manner that permits preparation of an adequate synopsis, if necessary.
