Wisconsin Statute § 108.09(6)(d), provides that the commission may affirm, reverse, modify or set aside the appeal tribunal decision on the basis of the evidence previously submitted, may order the taking of additional evidence, or it may remand the matter to the department for further proceedings. Pursuant to authority granted in Wis. Stat. § 108.09(6)(d), the commission sets aside the appeal tribunal decision in the above-referenced matter and remands the matter for a new hearing and decision by a different ALJ.

NOTE: The commission remands this matter for a new hearing and decision because approximately the last 30 minutes of the hearing were not recorded. In the event a party was to seek judicial review, the commission would be unable to provide the court with all the testimony taken. See, Sheridan v. Village of Woodville Saint Croix County, UI Dec. Hearing No. 06202043HU (LIRC Oct. 17, 2007) (the requirement to provide the court with all testimony requires preparation of a verbatim transcript which must be prepared from the audio recording of the hearing made by the administrative law judge).
