MC 605 - Missing work due to being incarcerated is not a valid reason for missing work if there is evidence in the record of culpability for the behavior that led to the incarceration. In this case, the record established that the employee entered a guilty plea for the conduct that lead to his incarceration and caused him to miss multiple scheduled shifts.

VL 1005 - The employer changed the employee's schedule from daytime to nighttime shifts, and it required him to work an additional day each week. The employee had informed the employer during his initial interview that he could not work overnight shifts. While it was reasonable for the employer to seek to train a replacement following the death of one of its workers, there was no evidence that the employer had no option but to transfer the employee. The unilateral change to the employee's job duties amounts to employer fault.
